This Privacy Policy explains how Artly AI (“we,” “us,” or “our”) collects, uses, stores, and shares the data of our subscribers (“you” or “subscribers”) when you use our AI-powered art generation and subscription services (the “Services”).

We are committed to protecting your privacy and handling your data transparently and securely.

1. Information We Collect

We collect the following categories of information from our subscribers:

A. Subscriber and Contact Information

We collect information to create and manage your account, communicate with you, and process subscription payments:

  • Identity Data (for account creation and management): your name and username.
  • Contact Data (so we can contact you about your account, services, and promotions): your email address and phone number. Promotions can include SMS marketing, but only where you have explicitly opted in.
  • Payment Data (to process subscription payments): your billing address and tokenized payment method details.

B. Usage Data

We collect information about how you use the Services in order to generate your artwork, personalize your experience, maintain security/stability, and (where applicable) support location-based functionality:

  • AI Interaction Data: the prompts, inputs, and parameters you provide to the AI model. We use this to generate the artwork and to improve the AI model’s performance and relevance.
  • Generated Art: the images and other content generated for you by the Services. We use this to provide the service, store content in your account history, and it may be used for model training (see Section 3).
  • Viewing History: records of which generated images and features you view and interact with, used to personalize your experience and recommend relevant features or styles.
  • Technical Data: your IP address, device type, operating system, and browser type, used to maintain the security and stability of our Services.
  • Location Data: we may collect general location data (for example, city/state inferred from IP address). If you explicitly consent, we may also collect precise GPS data for location-based services. We use location data to provide location-specific content or offers, or to comply with regional legal requirements.

C. Communications Data

We collect information about communications so we can support you and manage mobile messaging preferences:

  • Support Records: records of communication between you and our support team, used to resolve issues and improve customer service.
  • SMS Interaction Data: records of your consent, opt-outs, and interactions with our SMS messages (including abandoned cart notifications), used to manage your communication preferences and provide the requested mobile services.

2. How We Store Your Data

We store your data using industry-standard security measures.

  • Subscriber and Payment Data are stored in secure, encrypted databases with restricted access. Payment details are handled by third-party payment processors (File for details), and we do not store full credit card numbers on our servers.
  • Generated Art and Viewing History are stored on secure cloud servers. We implement access controls to ensure that only you and authorized Artly AI personnel can view your private, generated content.
  • Data Retention: we retain your data as long as your subscription is active and for a reasonable period thereafter as required by law or for legitimate business purposes (for example, resolving disputes and enforcing our agreements). If you request account deletion, we will securely erase your personal data, subject to legal retention requirements.

3. How We Share Your Data

We do not sell your personal data. We share your data only in the following circumstances:

A. Sharing with Third-Party Service Providers

We engage trusted third-party companies to perform services on our behalf. Depending on the service, we share only what is necessary:

  • Cloud Hosting Providers: we share usage data and generated art so we can store and operate the Services.
  • Payment Processors: we share payment data and identity data to process subscription payments.
  • Analytics Providers: we share technical data and viewing history to understand usage patterns and improve the Services.
  • Customer Support Platforms: we share communications data and identity data to provide customer service and support.
  • SMS/Mobile Marketing Providers: we share contact data (phone number), SMS interaction data, and usage data (for abandoned cart) to facilitate SMS communications, including marketing and abandoned cart reminders, only with your explicit consent.

These service providers are prohibited from using your personal data for any purpose other than providing services to Artly AI. We do not share, sell, or rent your mobile phone number or SMS consent with third parties for their independent marketing or promotional purposes.

B. Sharing for AI Model Improvement (Training Data)

  • Prompt/Input Data: the text prompts and inputs you provide may be used in an anonymized and aggregated form to train and improve the Artly AI generation model.
  • Generated Art: we may use the art generated by the Services to further train and enhance the AI model. However, you have the right to opt out of the use of your generated art for training purposes via your account settings (File).

C. Sharing for Legal Compliance and Protection

We may disclose your information if we believe it is necessary to comply with a legal obligation (such as a court order or subpoena), protect and defend the rights or property of Artly AI, act in urgent circumstances to protect the personal safety of subscribers or the public, or investigate potential violations of our Terms of Service.

D. Sharing with Successors

If Artly AI is involved in a merger, acquisition, or sale of assets, your data may be transferred to the new entity or owner. You will be notified via email or a prominent notice on our website of any such change.

4. Your Choices and Rights

You have the following rights regarding your data:

  • Access and Correction: you can access and update most of your account information through your subscriber portal (File).
  • Opt-Out of Training: you can opt out of having your generated art used for AI model training via your account privacy settings.
  • Marketing Communications: you can opt out of receiving marketing emails from us by following the unsubscribe link in those emails. You cannot opt out of essential service-related communications.
  • SMS Marketing Opt-Out: if you have consented to SMS communications, you can opt out at any time by replying STOP to any message you receive. You may also receive a follow-up message confirming your opt-out.
  • Location Data Control: you can enable or disable precise location tracking through your device settings. If you choose not to share precise location data, certain location-based services may not be available.
